Disputes
The mediation process can be applied to nearly every type of dispute. It offers an alternative method for resolution which can be quicker, confidential and less expensive than litigation while delivering a legally binding, agreed settlement which is acceptable to all parties.
The parties or their advisors contact us to arrange to have a dispute resolved by mediation. EMS will to explain the process to them. If the parties agree to mediate, EMS will go through the process of appointing a mutually acceptable mediator, will arrange the venue and will organise that statements of the case and documents are made available to the mediator.
Prior to the day of mediation EMS will have a number of discussions with the parties and /or their advisors to ensure that all parties are clear about the process and are happy with it. This is a very important aspect and sets the process up with the best opportunity for success.

EMS mediators are highly qualified and skilled in mediation. They are carefully selected to suit the cases they mediate:
- All of the mediators on our panel agree to the EMS Code of Conduct
- The mediation process is flexible and allows for the negotiation of multiple issues in a conflict in order to achieve an agreed and lasting settlement
- Confidentiality before, during and after mediation is legally binding between all parties
- EMS mediators are neutral. Their role is to clarify issues, investigate opportunities for solution and to assist the parties to come to an agreement.
- EMS drafts or assists in drafting the agreement and if required will oversee compliance with its terms
- EMS offers one of the most comprehensive mediation services in Ireland. We specialise in corporate, commercial, workplace, personal and family mediation.
Facilitation
EMS has special expertise in helping parties to come to agreements where no dispute exists but where potentially one might. For example in helping parties with succession planning both in family businesses and for estate planning. EMS can help parties negotiate shareholder and joint venture agreements.
