Debt Management Mediation John Murray's The Business RTE

Karen Erwin and Michelle Lynch appeared on The Business RTE on Sunday 5 July to explain the Debt Management Mediation Model. The mediation fees for the Model are €350.00 for the Borrower and €2500.00 for the Lender. The mediation takes place in one day and both the borrower and the lender are encouraged to express their view to the other of the difficulties that they each face. After that has taken place the two parties will work out how best to move forwards to achieve a solution that suits both. The agreement that they reach will be legally binding and enforceable.

Debt Management Mediation Model of Mediation launched at Irish Banking Federation

Debt Management Mediation were the sponsors at a breakfast briefing of the Irish Banking Federation on 1 July 2009 where they launched their specifically designed Debt Management Mediation Model of mediation for use by Borrowers and Lenders. The Model was well received and clearly has a place in getting borrowers and lenders around the table to agree rescheduling of debt and/ or security.

Debt Management Mediation - joint venture.

EMS is delighted to announce a joint venture with Crannagh &Co where they will offer their Debt Management Mediation Model to Borrowers and Lenders. The Mediation Model has been devised specifically to cater for the relationship between borrowers and lenders where the debts have gone bad or where that is likely or a possibility. The Model enables the parties in a safe space to review their debts and security and to devise and agree a realistic arrangement to suit the needs of both.

The Model will be referred to at the Irish Banking Federation meeting on Wednesday 1 July 2009 which is being sponsored by Debt Management Mediation.

Elder Mediation International Symposium.

Karen Erwin chaired the legal panel in the recent Elder Mediation International Symposium. She also addressed the conference on behalf of The MII on the future of Elder Mediation in Ireland.

Over 60% repeat business or personal recommendation

On a recently completed audit of her cases in April 2009 Karen has ascertained that 61% of her cases have come either from personal recommendation or have been repeat business from satisfied clients.

IPA conference on mediation addressed

The IPA held a conference on mediation on 30 April 2009 on the benefits of mediation which was addressed by Karen Erwin in her capacity as President of the Mediators' Institute of Ireland.

South Dublin Chamber of Commerce - Erwin Mediation Services becomes a member

Karen Erwin has joined the South Dublin Chamber of Commerce in April 2009 and is working to promote mediation and conflcit resolution services.

 

Practitioner member of MII

Karen has achieved Practitioner member status of The Mediators' Institute of Ireland. She was the first person to qualify under the new requirements.

EMS makes submission to the Law Reform Commission on Alternative Dispute Resolution

In November 2008 EMS made a substantial submission to the Law Reform Commission in relation to the excellent LRC report and subsequently meet the Commission to discuss it.

NUI Maynooth - Law Council

Karen Erwin has become a member of the Law Council of NUIM.

Dublin Solicitors Bar Association

The DSBA asked Karen Erwin to present her new Collaborative Family Mediation Model to them - a copy of the paper can be viewed at Paper to DSBA March 2008. The model was devised by Karen Erwin to help couples with complex assets to mediate, retaining the support of their advisers throughout the process and within a "legal " framework whereby they come to a final binding agreement within the mediation.

Success of Mediation

Because of the confidentiality that surrounds mediation it is very difficult to get accurate information on how many cases are taking place and the outcomes of those cases. Mediators are precluded from giving their own "success rates". CEDR ( Center of Effective Dispute Resolution) conducted a survey late last year of those Mediators who trained with them and they give the aggregate settlement rate as 88%.

Appointment to the International Mediation Institute

The International Mediation Institute has a worldwide independent standards commission which is looking at what international standards should attach to mediation and Mediators. Karen Erwin has been invited to join this panel.

Collaborative family mediation model

Karen Erwin has developed a mediation model process to help high net worth divorcing and separating couples to come to agreement within the mediation process. It is a collaborative process where EMS Mediators work closely with the parties' Solicitors and other professional advisors as part of a team supporting the clients through the process.

For any of you who have been looking to see if this page has changed I apologise that I haven't been keeping it up to date. Apart from mediating, my role as President of The Mediators' Institute of Ireland takes up a lot of my time, and typically my own web site takes a back seat. Sorry.

Research

Due to confidentiality there is very little research done in relation to mediations. Karen is compiling information using her own cases to look for trends in mediation - types of cases, length of mediations and costs. This research will maintain client confidentiality but will draw on Karen's extensive practice to provide the information. The one figure that will not be included will be a personal success rate as it is against the Code of Ethics to give this information.

Presentation to Waterford Clinical Society

In February 2008 Karen Erwin gave a presentation to the Waterford Clinical Society on the uses and benefits of mediation for doctors and those in professional practice. The audience comprised medical practitioners and solicitors and one of the topics covered related to professional indemnity claims where professional negligence was alleged. The use of mediation for patients/ clients involved in stressful situations in the workplace or the home was described and discussed.

External Assessor

Karen Erwin has acted on a number of occasions as external assessor for Mediators at the certified level.

Re-Election as President

In November 2007 Karen was re-elected President of the MII ( The Mediators' Institute of Ireland). The MII is the professional body of mediators on the island of Ireland and has under Karen's presidency, had a complete governance and standards review.

Bullying at Work.

The ESRI have conducted Survey Reports on Bullying in the Workplace and the HSA have just produced a new Code of Practice March 2007. The Code recomends mediation using a trained Mediator as a means to resolve bullying disputes informally. See the EMS report on the Survey and Code

EMS have MII accredited Mediators with a wide range of experience and expertise to mediate bullying and harassment cases.
